The service

Open Vital is a health and fitness app that helps you view and interpret wellness, recovery, sleep, activity, healthspan, community, and coaching features using supported integrations and app data.

Accounts and eligibility

You must be legally able to agree to these Terms in your jurisdiction. You are responsible for keeping your account credentials secure and for activity that occurs under your account.

No medical advice

Open Vital is not a medical device, healthcare provider, or emergency service. Scores, trends, insights, and AI-generated responses are provided for informational and wellness purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.

Third-party integrations

Open Vital may connect to third-party products or services such as Garmin Connect, Apple Health, Strava, and AI providers. Your use of those services remains subject to their own terms and privacy policies, and we are not responsible for their availability, policies, or data quality.

Community and acceptable use

If you use team, invite, leaderboard, chat, or similar features, you may not harass other users, impersonate others, upload unlawful or abusive content, interfere with the service, or misuse access and invite systems. We may suspend or terminate accounts that violate these rules.

AI features

AI-generated insights may be incomplete, inaccurate, or unsuitable for your situation. Use judgment and do not rely on AI output as professional advice.

Availability, disclaimers, and liability

Open Vital is an evolving product and may change over time. To the maximum extent permitted by law, the service is provided "as is" and "as available" without warranties, and we disclaim liability for indirect, incidental, special, consequential, and similar damages arising from use of the service.

To the maximum extent permitted by law, and subject to any rights you may have under mandatory consumer protection law, our total liability for claims arising out of or relating to Open Vital will not exceed the greater of the amount you paid us for the service in the 12 months before the claim or EUR 100.

Governing law and venue

These Terms are governed by French law, without regard to conflict-of-law rules.

If you are acting as a business user or to the extent permitted by applicable law, disputes arising out of or relating to Open Vital will be subject to the exclusive jurisdiction of the courts of Paris, France.

If you are a consumer resident in the EEA, Switzerland, or the United Kingdom, nothing in these Terms is intended to deprive you of mandatory consumer protections or rights to rely on the laws and courts of the jurisdiction where you reside to the extent those protections apply under applicable law.
